this bill would also prohibit taking photographs from public roads farms. so jail people who want to expose animal cruelty, jail the photographer of aerial photography of an area where there is a farm, jail people who like to take a country drive and take a picture of a horse running in a field. NOW THE BIG SURPRISE !(rolls eyes)…THIS BILL AND ONES LIKE IT IN FLORIDA AND IOWA…are written and passed by REPUBLICANS.
I appreciate the logical legal argument of the defamation of a legitimately run business and protect against trespass…but this bill does not reinforce or solidify such an argument. Instead this is yet another manner in which to protect those who subvert our laws/regulations in the name of corporate gains. A more reasonable proposal would come back to the legal idea of “clean hands” doctrine.
CLEAN HANDS DOCTRINE: “a rule of law that a person coming to court with a lawsuit or petition for a court order must be free from unfair conduct (have “clean hands” or not have done anything wrong) in regard to the subject matter of his/her claim. His/her activities not involved in the legal action can be abominable because they are considered irrelevant. As an affirmative defense (positive response) a defendant might claim the plaintiff (party suing him/her) has a “lack of clean hands” or “violates the clean hands doctrine” because the plaintiff has misled the defendant or has done something wrong regarding the matter under consideration. “

I wish that our language used the same word for “hello” and “good bye”. So many others have done so. … “aloha”,”ciao”.Both sound so warm and inviting, an emotional affirmation rather than a definitive termination. Neither have the weight of the soliloquy “goodbye”. I am Italian-American so I say “ciao” often, but I haven’t never used it to mean hello, I have only used it as a friendly exit. I think I have become “too American”. I have become intimidated by “good byes” and the emotional compromises attached to the use of the word “love”. Hahaha, I love peanut butter but I stutter when I say the “word” to someone who affects me. I feel like someone who was caught doing something inappropriate. In truth, I give both words emotional and intellectual heft. I am not a recreational user. It is my sorrow. But at least my sorrow has some comfort … until the time comes when I have to say “good bye”.

Everything has pace. Whether it is a natural or conditioned rhythm. There are designations that we program our lives to follow…24 hours in a day, 60 minutes in an hour, 60 seconds in a minute. And then there are the more organic time lines that break up our lives…our biological rites of passage. We are well conditioned animals. I am a well conditioned animal. I recognize my impulses and then I form a strategy in which to handle them. So how do I handle the tension, attraction, comedy,and calm that moves like rushing waves over my consciousness?
As a well conditioned animal, I do not have faith in the instant coupling of relationships. A few dates in and I am in the deep? My response is usually… ”When did that happen? Where’s the door? I need to get out. Open a frickin’ window…open anything!”
But here is the rub… instant connections are a beautiful and amazing occurrence. I love them as much as cheesecake. But can you live on cheesecake? Truth is, you really can’t beat a damn good cheesecake.
